Johann Jacob Bankert's Sale of Portions of "Resurvey on John's Lott" and "Ohio" Tracts to Henry Gilbert, 1785

At the request of Henry Gilbert the following deed was recorded 13th September 1785 to wit,

This Indenture made the tenth day of September in the Year of our Lord one thousand seven hundred and eighty five Between Jacob Bankard of Frederick County in the State of Maryland of the one part and Henry Gilbert of the same place Farmer of the other part Witnesseth that the said Jacob Bankard for and in Consideration of the Sum of ten pounds Current Money him in Hand by the said Henry Gilbert paid the receipt whereof the said Jacob Bankard doth hereby acknowledge, and thereof doth acquit and discharge the said Henry Gilbert his Heirs Executors and Administrators hath given granted bargained sold aliened enfoeffed and confirmed and by these presents doth grant bargain sell alien enfoeff and confirm unto the said Henry Gilbert his Heirs and Assigns forever All that part of two Tracts of Land hereafter described situate lying and being in the County aforesaid, and Beginning at the end of eight Perches on the Given Line of a Tract of Land called Gilberts Delight an on or near the end of the eight perches on the eleventh Line of the Resurvey on John’s Lott, and running thence North forty-four degrees East one hundred and forty two Perches to the Beginning Tree of said Gilberts delight then South fifty six degrees East ten perches South twenty one and a half degrees West ninety eight perches South sixty three degrees East fifty perches South thirty two degrees West sixty five Perches and then by a straight Line to the place of Beginning containing for fifty acres of Land more or less it being part of the aforesaid Tract of Land called “The Resurvey on Johns Lott” and part of a Tract of Land called the “Ohio” Together with all and singular the Improvements Profits Benefits Priviledges and Advantages Premises and Appurtenances to the said bargained Tracts or parcels of Land belonging, or in any wise appertaining To have and to hold the said bargained Tracts or parcels of Land, with the premises Appurtenances, and every part and parcel thereof unto the said Henry Gilbert his Heirs and Assigns forever and to his and their only proper Use and Behoof.  And the said Jacob Bankard for himself and his Heirs doth hereby covenant and grant promise and agree, to and with the said Henry Gilbert his Heirs and Assigns that he the said Jacob Bankard and his heirs shall and will warrant and defend the said bargained Tracts or parcels of Land and Premises with the appurtenances and every part and parcel thereof unto the said Henry Gilbert his Heirs and Assigns forever against all manner of Persons lawfully claiming, or which may hereafter lawfully claim from by or under him the said Jacob Bankard or his Heirs or  by other means or Procurement.  In Witness whereof the said Jacob Bankard set his Hand and Seal the day and Year above written.

On the Back whereof were the following Endorsements to wit:

Received the Day and Year first within written of Henry Gilbert the Sum of ten pounds Current Money it being the Consideration as within mentioned, as Witness my Hand.

On the 10 Day of Septr 1785 Came Jacob Bankard before us two of the Justices of the peace for Frederick County, and acknowledged the within deed to be his Act and the two parcels of Land hereby bargained and sold to be the Right Title and Estate of the within mentioned Henry Gilbert his Heirs and Assigns forever according to the true Intent and Meaning of said deed.  Also Esther Wife of the said Jacob Bankard being by us examined out of her Husband’s Hearing acknowledged all her Right of Dower to the said bargained Parcels of Land to be the Right Title and Estate of the said Henry Gilbert his Heirs and Assigns, and declared she made such Acknowledgement of her own free and voluntary will without being induced so to do by her Husband, or through fear of his Displeasure.
