Johann Jacob Bankert's Purchase of "Jacob's Lot" and "Christopher's Lot," 1755

At the Request of Jacob Banker the following Deed was Recorded August the twentieth Day in the year of our Lord Seventeen hundred & fifty five To wit

This Indenture made this twenty seventh day of July in the year of our Lord one thousand Seven hundred fifty and five Between Doctor Charles Carroll of the City of Annapolis Merchant of the one part and Jacob Banker of Frederick County farmer of the other part Witnesseth that the said Charles Carroll for and in Consideration of the Sum of Twenty pounds Current Money of Maryland to him in hand paid by the said Jacob Banker the Receipt whereof he Doth hereby Acknowledge Hath granted Bargained Sold Aliened Transferred and made over and by these presents doth Grant Bargain Sell Alien Transfer and make over unto the said Jacob Banker his Heirs and Assigns for ever all that Tract or parcel of Lad called and known by the Name of Jacobs Lott with its Appurtenances and also all houses Orchards Gardens fencing Woods Underwoods Grain in the Ground or Growing and all other the Advantages thereon or thereto in any wise belonging or appertaining.  To Have and to Hold unto him the said Jacob Banker his Heirs and Assigns for ever the said Tract of Land called Jacobs Lott containing forty eight acres of Land Situate in Frederick County near the Head of Great Pipe Creek as aforesaid being the Dwelling Plantation of him the said Jacob Banker with its appurtenances and the said Charles Carroll doth Covenant and agree to and with the said Jacob Banker his Heirs and Assigns that he the said Jacob Banker his Heirs or assigns for ever shall and may peaceably and quietly have hold Use Occupy Possess and Enjoy the said Land and Premises above mentioned and every Part and Parcel thereof as well against him the said Charles Carroll as against all manner of Person or Persons Claiming or to Claim by from or under him.  In Witness whereof the said Parties to these Presents have hereunto Interchangeably Sett their Hands and Seals the Day & Year first above Written.

Frederick &c.  Know Ye that for and in consideration that Jacob Banker of Frederick County in our said Province of Maryland hath due unto him fifty acres of Land within our said Province by virtue of an assignment for that quantity from Samuel Beall Junior of the County afsd being part of a Warrant for two thousand acres granted the said Beall by renewment the twenty ninth day of April seventeen hundred and fifty five as appears in our Land Office and upon such Conditions and terms as are expressed in Our Conditions of Plantation of our said Province bearing date the fifth day of April Sixteen hundred and Eighty four and remaining upon Record in Our said Province together with such alterations as in them are made by our further Conditions bearing date the fourth day of December Sixteen hundred and ninety Six together also with the alterations made by our Instructions bearing date at London the twelfth day of September Seventeen hundred and twelve and Registered in our Secretarys Office of our said Province together with a Paragraph of Our Dear Fathers Instructions bearing date at London the fifteenth day of December Seventeen hundred and thirty eight and Registered in Our Land Office We do therefore hereby Grant unto him the said Jacob Banker all that Tract or parcel of Land called Christophers Lott lying and being in the County aforesaid Beginning at a markt stone standing two Perches from a Black Oak markt with six notches and on the East Side of a Hill near a Draught of Great Pipe Creek called Bentleys run and running thence North thirty Degrees West eighty Perches North Sixteen Degrees East twenty Perches North twenty one Degrees and an half Degree West forty Perches north twenty eight Degrees and an half Degree East twenty eight Perches South forty six Degrees East forty eight Perches South twenty one Deg.s East forty eight Perches north sixty four Degrees East twenty Perches north twenty one Degrees East thirty Perches South sixty nine Degrees East twenty Perches South fourteen Degrees West Sixty Perches South forty Degrees West twenty four Perches south twenty five Degrees West twenty four Perches then by a straight Line to the Beginning Containg and now laid out for fifty Acres of Land more or less according to the Certificate of Survey thereof taken and returned into our Land Office bearing date the Sixteenth day of May Seventeen hundred and fifty five and there remaining together with all Rights Profits Benefits and Privileges thereunto belonging (Royal mines excepted) to have and to hold the same unto him the said Jacob Banker his heirs and assigns for ever to be holden of Us & Our Heirs as of our Manor of Conogochaigo in free and common Soccage by fealty only for all manner of Services yielding and paying therefore yearly unto Us and Our Heirs at Our Receipt at Our City of Saint Marys at the two most usual feasts in the year Viz the feast of the Annunciation of the Blessed Virgin Mary and Saint Michael the Archangel by even and equal Portions the rent of One shilling Sterling in Silver or Gold and for a fine upon every Alienation of the said Land or any part or parcel thereof one whole years rent in Silver or Gold or the full value thereof in such Commodities as We and Our Heirs or such Officer or Officers as shall be appointed by Us and Our Heirs from time to time to Collect and receive the same shall accept in discharge thereof at the choice of Us and Our Heirs or such Officer or Officers aforesaid Provided that if the said sum for a fine for alienation shall not be paid unto Us and Our Heirs or such Officer or Officers afsd before such alienation and the said alienation entered upon Read in the Provincial Court or County Court where the same parcel of Land lieth within One month next after such Alienation then the said Alienation shall be void and of no Effect Given under our Great Seal of our said Province of Maryland this Sixteenth day of May Anno Domini Seventeen hundred and fifty five Witness our trusty and well loved Horatio Sharpe Esquire Lieutenant General and Chief Governor of our said province of Maryland Chancellor and Keeper of the Great Seal thereof.
