Last Will & Testament of
Charles Hedrick Decsd.
I Charles Hedrick of Marion in the State of Indiana do make and
publish this my last will and testament hereby revoking and making void
all other wills by me at any time heretofore made.
First I direct that my
body be decently interred and as to such worldly estate as it has pleased
God to entrust me with I dispose of the same in the following manner to
wit, I direct first that my just debts be paid. I also direct that
my executors pay out of the first moneys that may come into their hands
all my funeral expenses and I give and bequeath all the remainder of my
personal property to my beloved wife Eliza Hedrick. I also
give and bequeath in like manner to her the house and lot on which I now
reside together will all other property of every kind to have and enjoy as
she thinks proper so long as she remains my widow but in the event that
she again marries then said house and lot I will to my beloved children
share and share to be enjoyed and disposed of by them when they arrive at
full age as they may deem proper and in order to carry into effect this my
last will and testament I appoint my beloved wife Eliza Hedrick and
my brother David Hedrick executors of this my will and testament.
In witness whereof I Charles Hedrick the testator have hereunto set
my hand & seal this seventh day of February Eighteen hundred and Forty
nine.

Pittsylvania Co., Virginia Will Book 2 pgs. 78 & 79
24 April 1848
I Jacob Hedrick of the County of Pittsylvania and the State of
Virginia being of an advanced age and calling to mind the uncertainty of
life and the certainty of death and being of sound mind and memory do make
and ordain this my last will and Testament as follows--
1st It is my will that
all my just debts & funeral expenses be first paid out of my Estate.
2nd I give to my son
John Hedrick the sum of one hundred Dollars.
3rd I give to my son
George Hedrick's 2 children Mayran & Jacob Hedrick the
sum of ten dollars each.
4th I give to my son
David Hedrick the sum of one hundred Dollars.
5th I give to my son
Abram Hedrick the sum of one hundred dollars.
6th I give to my Daughter
Sopha Hedrick the sum of one hundred & fifty Dollars, is to put at
interest by my Executor hereinafter appointed and the interest paid to her
annually during of her life [sic] and after her death to be paid to her
children.
7th I give to my Daughter
Rosey Hamack the sum of one hundred dollars.
8th I give to my daughter
Susanah Julious the sum of one hundred dollars.
9th I give to my daughter
Mary Hamack the sum of one hundred dollars.
10th I give to my son
Saulious Hedrick the sum of one hundred dollars.
11th I give to my son
Philip Hedrick the tract of land he now lives on by his paying back to
my Estate the sum of one hundred and fifty dollars, seventy five dollars
to be paid twelve months after my death and the other seventy five dollars
paid two years after my death and in case the hundred & fifty dollars is
not paid over to my Executors within the two years named my Executors
shall sell so much of the said tract of land as will pay the above sum of
one hundred & fifty Dollars and what Interest that may accur [sic] on the
above sum.
12th I give to
Cathrine Mayhew & her three children Mayran, Cathrine, &
Jacob Mayhew the tract of land where I now live, containing one
hundred and fifty acres, to be rented out by my Executor till the youngest
child comes of age the rent to goe [sic] to the support of the said
Cathrine Mayhew & three children and also to the eddecation [sic] of
said children, I wish the plantation to be rented for a part of what is
made on said land, I also give to the said Catharine Mayhew & three
children the following list of property, two feather beds & furniture, two
bed steds, 3 chairs, one pine table, 1 pine chest painted, 2 pots, 2
skillets, 2 choist [sic] cows, 1 cotton wheel, two pr cards, 1 sett [sic]
knives & forks, half Dozen earthen plates, 2 pitchers, 1 coffee pot, 1
coffee mill, 1 barrel wheat, 2 buckets, 4 choist hogs, one pole ax, two
hundred pounds pork, loom[?] & geer[?], 1 rocking cradle, 1 set table
spoons, one flax wheel, also two dollars and if there should be any little
article at my sale the said Cathrine Mayhew should want she is to
have it.
13th I wish so soon after
my death as my Executor may think it proper I wish for him to sell all my
lands & negroes and other property that is not will away or sold on such
credit as he may think proper. I also wish my Executor to have full
time to collect the sale arising from my Estate and the above sums that
are willed to my children & Gan[?] children are not to be paid till the
sales and other money are collected that are due to my Estate. I
appoint Charles S. Haley my Executor to this will this is my last
will and Testament revoking all others heretofore made by me. Given
under my hand in presence of this 24th April 1848.

At a Court held for the County of Pittsylvania the 16th day of April 1849
"The last will and Testament of Jacob Hedrick Decsd. was produced
in Court by Charles S. Haley, the Executor therein named in order
to be proved--whereupon came John, David, Saulus, Abram & Philip
Hedrick, George Julius and Susan his wife and
Taliaferro Hammock and Mary his wife and opposed the proof of
the said will and for reasons appearing to the Court the same is continued
till June Court next"
And at another day to
wit: At a Quarterly Court continued & held for the County aforesaid,
the 19th day of June in the year aforesaid. "The writing purporting
to be the last will & Testament of Jacob Hedrick Decsd. bearing
date the 24th day of April 1848 was this day again produced in Court by
Charles S. Haley the Executor therein named in order to be proved and
John, David, Saulus, Abram & Philip Hedrick, George Julious
and Susan his wife and Taliaferro Hammock and Mary
his wife, appeared & opposed the proof of the said will--whereupon sundry
witnesses were sworn and examined and the arguments of counsel of both
parties fully hears, upon consideration whereof it is unanimous opinion of
the Court that the said Jacob Hedrick was at the time of executing
the said will of sound and disposing mind & memory, that he was under no
undue influence, and that the said writing be recorded, as the last will
and Testament of the said Jacob Hedrick Decsd. "on the motion of
Charles S. Haley the Executor named in the last will and Testament of
Jacob Hedrick Decsd. this day, ordered to be recorded who made oath
thereto and together with William A. Anthoney and Samuel Berger
his securities entered into and acknowledged their bond in the penalty of
four thousand Dollars conditioned as the law directs, certificate is
granted him for obtaining probate of said will in due form."

The last will and testament of Mary F. Hedrick, of Van Buren, Grant
County, Indiana.
I, Mary F. Hedrick,
considering the uncertainty of this mortal life and being of sound mind
and memory do make and publish this my last will and testament in manner
and form following to-wit;
Item 1st; It is my will
at my decease that I give and bequeath to Rufus F. Ballard my Van
Buren town property and being Lot number eighteen (18) in William
Chopsons first addition to the town of Van Buren, Grant County,
Indiana, the said Rufus F. Ballard is to have this property and the
same shall be his in Fee simple dispose of it as he sees fit to do, it
shall be his to sell, will or do as he so sees best to do, and the same
shall be his forever.
Item 2nd and I want to
give to Willie Ballard one hundred ($100) dollars in money out of
my estate after my decease, and the same shall be his forever.
Item 3rd. It is my
will at my decease that Ethel L. Oliver is to have one hundred
($100) dollars in money out of my estate and the same shall be hers
forever.
Item 4th. It is my
will at my decease that Francis B. Oliver is to have one hundred
($100) dollars in money out of my estate and the same shall be his
forever.
5th Item. It is my
will at my decease that I give to Edith L. Oliver, my gold watch
and chain, fob and bed room suit with a good bed and the same shall be
hers.
6th Item. It is my
will at my decease all the remainder of my estate both real and personal
property after the above items 1, 2, 3, 4 & 5 are taken out and settled
for, it all shall go to Lucinda M. Oliver, and being my 20 acres of
land and described as follows, the south east part of the south west
quarter (1/4) of Section 32, Township 25 North, range ten (10) east
bounded as follows, to-wit:
Commencing at the south
east corner of said south west quarter (1/4) thence north 120 rods; thence
west 40 rods, thence south 120 rods, thence east 40 rods to the place of
beginning, except the undivided 1/3 of the above described land formerly
was deed to Lucinda M. Oliver, by said Mary F. Hedrick,
leaving 20 acres this day willed to said Lucinda M. Oliver, and
said Lucinda M. Oliver is to have my note of $600 on William F.
Williamson and all money on hand and in Bank on deposit and all my
household furniture and personal property of whatever kind it may be and
wherever it may be that said Lucinda M. Oliver is to pay all my
debts if any Doctor bills, funeral and burial expenses shall be paid by
her out of her division and the same shall be hers in fee simple and she
is to have the same and dispose of it as she so sees fit to do and the
same shall be hers forever. Except 1 oil cook stove is to go to
Bertha Ballard and the same be hers.
I revoke all former wills
by me made in Testimony hereof I have hereunto set my hand and seal this
8th day of November, 1910.
