In the name of God Amen I Elijah Duest of the county of Barren and state of Kentucky being weak in body but of sound and perfect mind and memory blessed be allmighty God for the same do publish this my last will and testament in manner and form following- first I desire that all ?? funeral expences attending of my burial be paid likewise all of my just debts-then next I will and bequeath unto my beloved wife Nancy Duest all of my estate (of whatsoever kind or nature) both real and personal, whether in my posession or the possession of others unto her my said wife so long as she lives and at her death shall she have any child or children by me then a living to such child or children in absolute fee and shall she have no child or children by me at her death then all of said estate both real and personal to go to those who may be next untitled according to law or the known ? of decent as being in force and operation by the law of Kentucky further I hereby appoint my said beloved wife Nancy Duest sole Executrik of this my lst will and testament hereby revoking all former wills by me

Made - in witness when of I have hereunto set my hand and seal this twentieth day of September in the year of our Lord 1836 Signed Sealed
Published and declared by the above named Elijah Duest to be his Last will and testament in the presence of us who have here unto subscribed our names as witnesses in the presence of the testator

The foregoing writing purporting to be the last will and testament of Elijah Deweese deceased was on the last term of this court produced in court and proven by the oath of Henry Shirley one of the ? witness thereto and was fully proven at the present term of this court by the oath of Preston Cockran another subscribing witness ? to be the true last will and testament of said Elijah Deweese deceased and ordered to be recorded which is accordingly done
