January 19, 1540: [Dunscore] Copies of Letters under the Signet charging the sheriff to summon John, Lord Hay of Yester to compear before the Lords of Council on February 13, at the instance of John Grierson of Lag, allege pledge and surety for William Amiligane; and produce a decree dated June 17, 1539 and hear it declared of no avail because it had been given in the absence of said William and John, never lawfully summoned; and that the said John is not liable in terms of the Act of adjournal of Justice and that they ought not be pursued for 5 years profit of the lands, because the said William and [ ... ] Amiligane had a 3 year tack of the said land from [ ... ] Wilson who had them in assedation from Lord Hay.

February 17, 1540: [Dunscore] Certificate by Adam Forman, Mace stating that he passed on the January 22, 1539 to the 5 marklands of Tererran pertaining to John Grierson of Lag and decerned them to be appraised for the sum of £40 due to Lord Hay of Yester by Grierson as surety of William Amiligane and set a court to appraise them in the Tolbooth of Dumfries on February, 1539. On the said day he held a court in which Grierson and Lord Hay by his procurator, Roger Cunningham appeared before an inquest to appraise 2 marks worth of the said lands of Tererran and offered them for sale, but on receiving no fee from persons present at inquest, assigned the lands to Lord Hay.

July 14, 1541: [Dunscore] Action before the Lords of Council by John Grierson of Lag alleged surety for Sir William Amuligane against John, Lord Hay of Yester to produce a decreet of the Lords dated June 17, 1539 at the instance of Lord Hay against Grierson ordering him as surety to pay the profits of the lands of Gilmerston for 5 years, because Sir William had been indicted at the Justice court and took composition for the same and Grierson as surety. The Lords annul the decreet on the ground that it had been obtained without probation of intension or other writings and because Sir William had made composition in fear of his life.

February 23, 1542: [Tynron] Action before the Lords of Council by Gilbert Wilson of Corfandine and Thomas Wilson of Croglin as his pledge against Thomas Amuligane and Gilbert Amuligane; pursuer had obtained solvement in the sheriff court of Dumfries on December 20, 1541 ordaining the defenders to desist from occupying the three and half merk land of Netherside of Bennan in the barony of Tibbers, but they refused and the Lords decree the defenders to fulfil the solvement.

March 9, 1542: [Dunscore] Extract of Decreet of the Lords of Council in the cause of John, Lord Hay of Yester and his tenants (see no. 529) against John Grierson of Lag, the said Lord and Grierson compearing personally and the tenants by their procurator, Mr James Carmure, Grierson having handed in an exception (see no. 586), and Lord Hay a declaration upon (see no. 587). Case continued until 15 May of Lord Hay to answer to said declaration.

March 9, 1542: [Dunscore] Copy of Exception by John Grierson of Lag produced before the Lords objecting that the years for which damage is claimed is wrong; that Lord Hay had no action to purse for the profits of the years 1531 and 1532 because William Grier was then tenant of Gilmerston and he had granted him and paid off all damage; and for the preceding three years there should be no action because Thomas Wilson of Carrouht had these lands during that time.

March 9, 1542: [Dunscore] Declaration by John, Lord Hay of Yester upon receiving the exception produced by John Grierson of Lag and which narrated first, that William Amuligane held the lands of Gilmerston waste for 5 years; secondly that William Grier and Thomas Wilson were not his tenants during that time and thirdly, that the profits of Gilmerston, if Lord Hay had the lands himself should amount to £100, but nevertheless he claimed only £40 per annum, making a total of £200.

June 19, 1542: [Tynron] Memorandum narrating that Gilbert Grier in name and on the part of Gilbert Amuligane, dweller in the parish of Tynron, by William Oliver burgess of Dumfries, King’s messenger, by virtue of the King’s letter demanded of Thomas Amuligane and Gilbert Amuligane himself at the instance of Gilbert Wilson that they should remove themselves and their goods from certain merklands of Nethersyde of Bennan lying in the said parish; and the said Gilbert Grier in name and on part of the said Gilbert Amuligane obeyed the order contained in the said letter as to removal from and intromitting with the said lands. Memorandum narrating that William Sinclair, son and heir of William Sinclair of Auchenfranco deceased, passed to the principal messuage of the lands of Auchenfranco, lying in the parish of Lochrutton, and there presented to John McMorran a letter of bailliary and precept of clare constat, dated at Lag the last day of December, 1543, by John Grierson of Lag, superior of the lands of Auchenfranco, directed to the said John McMorran and John Amuligane his baillies in that part, and there gave sasine of the 100 shilling land of Auchenfranco to the said William Sinclair. March 17, 1544: [Sanquhar, Dumfriesshire] Action before the Lords of Council by Thomas Wilson, Archibald Aitken, John Dalziel, Thomas Aitken and John Amuligane parishioners of Sanquhar against Robert Crichton alleging himself to be parson of Sanquhar, and charged the complainers to pay their due teinds to him and Ninian Crichton of Bellibocht. The Lords decreet that they pay Ninian Crichton owner of the parsonage of Sanquhar.

March 5, 1545: [Tynron] Action before the Lords of Council by James Douglas of Drumlanrig against Patrick Cockburn of Newbigging heritable superior of the grounds of John Maitland of Auchengassel, Thomas Amuligane and John Hunter for the 21 merkland viz. 6 merkland of Craigencoon, 40 shilling land of Pinzarie, 40 shilling land of Corfardine and 40 shilling land of Killiewarren extending to 6 merks worth in the barony of Tibbers. It was alleged by John Maitland that he held Craigencoon, Pinzarie, Bennan, Killiewarren and Corfardine of Patrick Cockburn of Newbigging and produced a charter dated September 12, 1542 at Edinburgh, and James Hunter produced a charter by Patrick of half the land of Craigencoon dated July 4, 1541 at Edinburgh, and both desired a term to call the said Patrick to defend the said grants against James Douglas of Drumlanrig.

July 15, 1548: [Sanquhar] Instrument narrating that Edward Clerk, clerk of the parish of Sanquhar, in the presence of William, Lord Crichton, and the parishioners of Sanquhar, including Robert Amuligane, gathered on Sunday at the time of High Mass to hear divine service, resigned his office of clerkship into their hands by delivery of stoup and sprinkeler, whereupon William Crichton and the parishioners duly elected Thomas Clerk, son the said Edward, whom failing Edward himself, and presented the said Thomas to Sir John Young vicar of the church to the office of clerkship.

Auchmilling] with pertinents of auld extent lying in the lordship of Kylesmuir and sheriffdom of Ayr, in feu ferme and heritage for a sum of 6s 8d. as ferme, also 3d. for arrages and carriages and 3d. for the bondage silver of the lands. June 7, 1562: [Tynron] Letters of Obligation narrating that George Amilligane and William Amilligane in Bennan had by wadset of John Maitland of Auchengassel, elder, and his son, John Maitland, that is to say, George Amilligane had the 20 shilling land of old extent pertaining to Over Bennan with pertinents and the 20 shilling land of Corfardine with pertinents, and the said William Amuligane had the 40 shilling land of Nether side of Bennan and 20 shilling of the same extent of Corfardine with pertinents lying in the barony of Tibbers and sheriffdom of Dumfries. And because John Maitland and his son were to redeem the said lands respectively for payment of the sum contained in the reversions made thereupon, George and William appointed with the Maitlands to renounce the said lands with all titles to be infeft by the Maitlands. In the case of George’s heirs male of his body, which failing to Peter Amuligane and his heirs male, which failing to the George’s heirs male of the name of Amuligane, the 40 shilling land of old extent which he held by wadset. And in the case of William Amuligane’s heirs and assignees whatsoever in the 40 shilling land of old extent of the Nether side of Bennan, which he held in wadset, and that under reversion containing the same sum. Letters go on to narrate that the lands of Bennan and Corfardine lay in wadset to the Amuliganes with certain years tack after redemption thereof for payment of certain yearly rent contained therein till, which infeftments the said Maitlands made, subscribed and delivered to the Amuliganes, whereupon they made, subscribed and delivered reversions to the Maitlands thereupon for the aforesaid 40 shilling land of Corfardine with pertinents renounced to them without payment and deliverance of any sums of money or possession given by the them, the Maitlands, excepting only to the Amuliganes a letter of tack of the same lands of Corfardine for the payment yearly of 40 shilling mails paid equally at Whitsunday and Martinmas. The Maitlands then warrant to keep the “Millikens” in the said lands of Bennan and defend them, free from all feudal relief until the lawful period of redemption and out quitting by the sums of money contained in the letters of redemption made thereupon, and they also agree to defend the lands of Corfardine in tack to them. These letters were to be inserted in the books of Council and Session.
