[156] Patrick Amuligane in Gilmerston
November 17, 1531: [Glencairn] Letters made under the Signet at the instance of John, Lord Hay of Yester, narrating that on the last feast of Pasche [1531], Lord Hay put certain ploughs out to till his lands of Gilmerston in the barony of Snade. On 12th April, Patrick Amuligane and his accomplices came and cut his crop and ploughed fields in Gilmerston, and on the next morning, the sheriff went to apprehend Patrick, who had fled to the Peel pertaining to David Maxwell in Glenslen, but John Grierson of Lag caused his brother and household men to take Patrick and would not suffer the sheriff to take surety of him. Then on 13th November, Patrick came upon Johnne Lowrie, younger son to Johne Lowrie tenant in Gilmerston, dwelling in the Craigs and cruelly hurt and wounded him in his head and diverse other parts of his body and mutilated both his arms and legs, leaving him for dead. By the said letters, the sheriff of Dumfries, his deputies and Michael Smyth, Michael McKay and Thomas Craik where empowered to charge John Grierson of Lag to enter the said Patrick before the Justiciar or his deputies in the tollbooth of Edinburgh on 7th Sept., next to come to underly the law.

February 13, 1534: [Dumfries] Brief presented to the Burgh Court of Dumfries by Herbert Amuligane the [blank] deceased David Amuligane burgess of Dumfries, which brief had been lawfully endorsed by the officers Edward Johnstone baillie and James Kirkpatrick at the tollbooth, and there proclaimed, warned and charge all persons mentioned in the brief that they had not compeared to come and make their objections, and not compearing the said Herbert Amuligane requested that an act to be inserted in the court book.

February 13, 1534: [Dumfries] Action before the Burgh Court of Dumfries by Elizabeth Gladstane relict of the deceased David Amuligane alias Glover produced in judgement an instrument of sasine for infeftement of one back tenement lying in the burgh of Dumfries on the west side between the tenement of John Welsh on the north part and one tenement of John of Crosbie on the south part and there in the presence of the alderman and baillie protested that what was decerned and ordained by the Inquest that day turned her quitfee to no providence (sic. providice).

July 19, 1534: [Dumfries] ] Action before the Burgh Court of Dumfries by which Herbert Amuligane alias Glover offered him to brief lawfully at the next court that the moss that Herbert Curruthers occupied lying between John Newell’s moss on the one part and Thomas McLaine’s moss on the other part was and is his father’s own moss the 11 years bygone and that the said Herbert occupied the same wrongly and against the law.

October 31, 1534: [Lochrutton, Kirkcudbrightshire] Memorandum narrating that Gilbert Grierson in Pemarte (parish of Keir), publicly warned John Watson, John Huchoune, John Amuligane and the rest of the tenants and inhabitants of the 20 merkland of new extent, the £5 land of old extent, of Auchenfranco to remove themselves and their belongings from further occupation and intromission with the said lands, which belonged to Gilbert, so that he might intromitt therewith freely and without impediment from the said persons.

November 12, 1534: [Dumfries] Action before the Burgh Court of Dumfries in which Agnes McBrime appeared as a sworn witness in the case of Jonet Amuligane against Elizabeth Gledstane. Also John Newell younger is sworn in judgement and depones that David Amuligane sold to Jonet Amuligane his daughter certain items including, one tyne quart, one tyne pint, three tin ‘trownschore’, one tin plate, one brazen chandler for the sum of 16 shillings paid to him therefore. Also Christopher Lowrie swore and depones that he knew right that same vessels present in judgement were sold by David Amuligane to Jonet Amuligane his daughter for the 16 shillings. Also Jonet Amuligane swore and depone in judgement that she gave David Amuligane her father the sum of 16 shillings for three tin ‘tr … schores’, one tyne quart, one tyne pint, one powder plate, one brass chandler and that she had nay other powder vessel nor candlesticks than was present in [unclear]ment before aldmerman and baillies that instant tyme.

December 20, 1536: [Glencairn] Letters under the Signet directed to Ninian Dazell and Alexander Donaldson sheriffs to summon William Amuligane and John Grierson of Lag, as pledge and surety, to appear before the Lords of Council at Edinburgh on 28th February, 1537, at the instance of John, Hay of Yester, to answer charges for damage committed by the said William in destruction pertaining to the land of Gilmerston belonging to Lord Hay in Snade and of his tenants William Grier, John Taggart, John Heron, Alexander Cottis, John Moffat, Malcom Halliday, Andrew McGown, Micol McKittrick, Rob. McClangberoun, Elizabeth McClangberoun, Matho McGown, Gilbert McGown, John McGown, Cuthbert Amuligane, Gelcus McConnel poor tenants of Lord Hay, by the destruction of 1 plough pertaining to the above tenants in the lands of Gilmerston in the year 1531, valued at 40 shillings. Also to compensate William Grier for the down casting by William Amuligane of 100 roods of dyke of his mailing in Gilmerston, value 23 merks. Also to refund Lord Hay the profits of said lands for 5 years past preceding 1533, extending to £40. Endorsement bears that Alexander Donaldson summoned Amuligane and Grierson on 19th January 1537.

Transcription: ‘Anent the summonds rasit at the instance of Johne Amuligane in blakmyre agains Jhone Douglas in Mure James Douglas of Drumlanrig as plege and suretie for him confeit? [conveyit?] Them be decree be do not? [condenator?] Of the Lords Counsell to refund content and pay to the said John Amuligane the profits that he myt haif had of his 20s. Lands of Blakmyre of auld extent with the pertinents pertaining to him in heritage liand with the sheriffdom of Dumfreis and the said Jhon Douglas had sufferit him personally occupy and laubored the samyn with his awn guids and had not violently occupyit be himself and others in his name be the space of ane yeir and ane half following Witsonday the yeir of God 1534 yeirs extending yearly to 16 bolles aitis sowing estimat to the third corn great measure of Nithisdale the price of the boll with the fodder yearly [here is a word I cannot read very abbreviated] 22/-and divers otheris cornes like at mairlentch [length] is contenit in the said summonds. May 20, 1539: [Carsphairn/Balmaclellan] Exchequer account of the Steward in Kirkcudbright who will be answerable for £315 of the rent of the 100s. lands of Crogo of old extent with pertinents viz. 5 merkland lying within the parish of Balmaclellan and 2 merkland with half merk land lying in the Holm of Dalquhairn within the parish of Dalry and his Stewartry being in the hands of the King for the space of 21 years lately passed (by) reason (of word) which rents amount annually to £15 owed to the King by sasine granted to John Amuligane of the same. June 17, 1539: [Dunscore] Lords of Council issued a decree against William Amuligane and John Grierson of Lag decerning that John Grierson of Lag pay the said profit to Lord Hay for damages to his lands in Gilmerston as stated in previous writs. Followed by Letters of Signet to Sheriff of Dumfries and Adam Forman, Herald to appraise the lands of John Grierson of Lag as surety for William Amuligane for the profits of Gilmerston to Lord Hay of Yester. Endorsement bears that Adam Forman on January 21, 1539 was unable to apprehend moveable goods of Grierson and went on the 22nd to Grierson's lands of Tererran in the barony of Glencairn and set a court to be held at Dumfries on February 17, to appraise the said lands.

September 8, 1539: [Dumfries] Memorandum narrating that Margaret Jardine, relict of the late John Gladstane of that Ilk, granted to Sir Herbert Paterson power of intromission with all the rents, profits and oblations of her chaplainary of St. Lawrence for the term of her life. Done at the notary’s chamber and witnessed by Thomas Menzies of Solands, John Amuligane and David McGee.
