November 21, 1618: [Dunscore] Instrument of Sasine given up by a discreet man Rodger Kirkpatrick burgess of Dumfries heritable proprietor of the lands underwritten with a parchment containing a precept of Sasine to be given to a discreet man John Milligane in Edzertoun his heirs and assignees heritably and without reversion of all and haill the 6 shilling and 3 pennies land of Edzertoun of auld extent with the pertinents lying in the parish of Dunscore and sheriffdom of Dumfries. The precept was dated January 28, 1611 and written at Dumfries, with no Milligan witnesses to the precept. Sasine was given at 9 am on November 21, 1618, and witnessed by John Edger in Edzertoun, Jon McKynnell there and Jon Douglas in Mcthymsoun?.

April 17, 1620: Instrument of Sasine taken at the hand of Homer Maxwell, notary public, narrating that John Wallace in Carsmill as baillie Thomas, Earl of Melrose, on a precept dated November 6, 1619, dated at Edinburgh, and witnessed by Thomas McCulloch, servitor to the said Earl, and Mr. George Davidson, W.S., infeft Fergus Amuligane of Meikle Dempsterton in the 10 shilling land of the land of Meikle Dempsterton formerly occupied by the deceased William Amuligane and now by Fergus, provided the grantor is not held to warrant the infeftment against any infeftment given to a previous infeftee on the right pertaining to John Kirkpatrick of Frairs Carse. December 24, 1636: Instrument of Sasines headed in favour of James Milligane son of John Mulligane of Newton of Little Dempsterton. This is a translation and paraphrase. On 24th December 1636, to me notary public and witness subscribing, compeared personally a discreet man John Muligane of Newton of Little Dempsterton on the grounds of these lands, with letters of vendition, disposition and alienation, made and given by the said John to James Muligane his lawful son, procreate between him and Euphemia Gardiner his wife, and his heir apparent, of these lands held in feu-ferme by John Muligane, dated 24th December 1636. To give state and sasine of the 7s. 6d. lands of Newton of Little Dempsterton of extent and its pertinents lying in the parish of Dunscore and sheriffdom of Dumfries, to James Muligane his son present and accepting, by the handing over of earth and stone of the ground of these lands into his hands. To be held of the foresaid John his father in free blench ferme by the payment of 1d. Scots at the feast of St. Martins and the feast of Pentecost, if asked for. Reserving to the foresaid John his life rent. So these letters of vendition, disposition and alienation were acted out and given to the said James Muligan by me notary public, of the lands of Little Dempsterton on this day at about 12 O’clock. January 12, 1639: Letters of Supplication raised at the instance of John Mullikin in Newtounhead against Cuthbert Mullikin burgess of Dumfries and John Johnston called of Templeland his assignee, craving suspension of letters obtained by the Cuthbert against John for not paying to the said suspender of 300 merks and infefting the said John Johnston in the 7s. 6d. land of Little Newtoun of Dempsterton. The Lords suspend the letters of horning purchased by the defender.

[42] William, Fergus & Robert Milligan of Meilke Dempsterton
April 29, 1645: Retour of Chancery by virtue of a dispensation through the Lords of Council and Session to the effect specially directed below on April 18, 1645. Inquest held at Dumfries. All the men on the inquest are named including a William Mulligane. The inquest declared that the late Fergus Amuligane in Meikle Dempstertoune father of Robert Amuligane there bearer of these presents, died last vest and seized as of fee at peace and faith of our sovereign Lord the King of all and whole the 10/- land of Meikle Dempstertoune of old extent with pertinents formerly possessed by the late William Amuligane father of the said late Fergus, then by the foresaid Fergus and now possessed by the said Robert, lying in the parish of Dunscore and sheriffdom of Dumfries, and that the said Robert is the lawful and nearer heir of the late Fergus his father and his is of lawful age and that the said 10/- land is now valued at 16s Scots as well as the old duties ….. the said lands were once held of the late Thomas Earl of Melrose thereafter the Earl of Haddington and are now held of the King by virtue of the resignation of the ecclesiastical land into his hands …….. the said lands have been in the king’s hands since the death of the late Fergus who in October 1633, through the failure of Robert Amulligane to pursue his right.

June 20, 1645: Crown Precept of Sasine from Chancery to infeft Robert Amuligane as heir to his father the deceased Fergus Amuligane in Meikle Dempsterton in the 10 shilling land of the lands of Meikle Dempsterton formerly possessed by the deceased William Amuligane father of the said Fergus and then by the said Fergus and now by the said Robert, lying in the parish of Dunscore, formerly held in chief of Thomas, Earl of Melrose, and now of the crown by virtue of resignation of Kirklands, which lands had been in the had of the crown for 12 years from the recovery of sasine.

May 26, 1645: Instrument of Sasine headed in Index John Milligane of Dempsterton, but in the book the margin has ‘sasine of James Milligane of the 10/- land of Meikill Dempsterton’. This is a translation and paraphrase. Registered at Edinburgh on 26th May 1645 in favour of John Milligane of Dempsterton. By this present public instrument it is clear and known that on 9th May 1645 to me notary public and witnesses subscribing there came a discreet man John Fleming official in the sheriffdom of Dumfries and baillie in that part constitute, having and holding in his hands certain letters of disposition and alienation by the name of John Milligane of Dempsterton dated 30th April 1629 at Croffurd (Crawford) to the following effect … on all and whole the 10/- land of Meikill Dempsterton with house buildings yards tofts crofts of old extent, and pertinents lying in the parish of Dunscore and sheriffdom of Dumfries, with houses buildings yards tofts crofts mosses fields the infield and out field muirs common pastures parts pendicles and pertinents there to belonging … The said John Fleming baillie aforesaid by virtue of the letters of disposition alienation and resignation therein contained, resigned renounced and purely and simply returned the staff, and gave from the foresaid John Milligan his heirs and assignees without reversion redemption and regress on all and whole the said 10/- land of old extent with pertinents lying as above said, along with rights and titles belonging to the said John Milligane which he may have or claim to have to the 10/- land in favour and in virtue to the said James Milligane of Newtownhead his heirs and assignees whomsoever, by the donation of earth and stone. The resignation being made and accepted through the said baillie, the foresaid John Fleyming baillie aforesaid, gave state sasine heritable real actual and corporal possession of all and whole the said 10/- land with pertinents lying as above to the memorable James Milligane there personally present and accepting the same, by donation of earth and stone as is the custom, paying annually one silver penny usual Scots money on the ground of the said lands at the feast of Pentecost if asked for. Upon which all and sundry the foregoing the said James Milligane of Newtonhead took instruments from me notary public. November 8, 1645: Instrument of Sasine taken at the hand of John MacBurnie, notary public, narrating that following a crown precept, John Crichton of Crawfordtoun sheriff deputy of Dumfries infeft Robert Amuligane as son and heir of the deceased Fergus Amuligane in Meikle Dempsterton in 10 shilling land of the lands of Meikle Dempsterton in the parish of Dempsterton formerly possessed by the deceased William Amuligane father of the said Fergus and then by the said Fergus, in the hand of the crown for 12 years. June 15, 1658: Testament dative of John Mulligane in Dykehead of Laggan who died in the month of etc 1600 etc, years. It was faithfully given up by James Forman and Robert Grersone as having best knowledge in name and behalf of Robert and William Mulligane bairns lawful and only executors dative above as well nearest of kin to the said defunct be decreet of the Commissioner of the Commissariot of Dumfries upon the etc date of etc 1600 etc years.

[50] Robert Mullican grandson son of John Mullican
January 21, 1670: Instrument of Sasine in favour of Robert Mulligane of a 7/6d land of the lands of Newtoune. Compared Edward Kirkpatrick in Kirkland of Irongray baillie in that part to John Mullican portioner of Newtoune, with a charter of alienation containing a precept of sasine made ‘in favour of Robert Mullican lawful son of the late James Mullicane eldest son of the aforesaid John Mullicane in heritable infeftment to him and his assignees without reversion, redemption or regress of all and whole the 7s. 6d. land of the 30 shilling land of Newtoune of old extent occupied by Robert himself’ lying in the parish of Dunscore. Later on, when the notary reads the precept of sasine, this 7s. 6d. land of Newtoune is described as “vocat lie Newtounheid” called Newtounheid. The charter containing the precept of sasine is dated January 11, 1670, and drawn up at Newtouneheid and witnessed by Edward Kirkpatrick in Kirkland of Irongray, Thomas Smith in Dempsterton, Mr. Robert Burnet minister at Dunscore and James Smith notary public. The sasine was given up at about 12 noon on January 21, 1670, and witnessed by Mr. Robert Burnet minister at Dunscore, Thomas Smith in Dempsterton, John Smith of Ferdingrush and Robert Smith in Largum.

[51] Robert Mulligan, portioner of Dempsterton
December 22, 1671: The Testament Testamentar and Inventar of the Goods etc pertaining to the deceased Robert Grierson, younger, portioner of Laggan at the time of his decease in the month of December 1671. Made and given up by the said Robert on December 22, 1671, and by John Smith of Bridgend of Miniaive in name and on behalf of Robert, James and Jean Grierson lawful bairns and only executor dative to the said defunct. The said Inventar of goods records a sum paid to Robert Mulligan in Dempsterton. By his last will, Robert Grierson nominated Robert, James and Jean Grierson, his lawful bairns, his only executors, and nominated Janet Gilchrist his spouse Tutrix to John, Robert, James and Jean his lawful bairns and ordains Thomas Grier of Laggan, John Smith at Mingene, John Smith of Kilroy and Thomas Gilchrist his father-in-law overseers to his said spouse and bairns. December 2, 1672: Instrument of Sasine in favour of Janet McMurdie. Compared a discreet gentleman James Grierson of Dalgonar attorney for Janet McMurdie spouse to Robert Mulligane of Newtounhead heritable proprietor of the ‘seventh shilling and six pennie land of the threttie shilling of Newtoune’, with a contract of marriage bearing infeftment with a precept of sasine made and subscribed by the said Robert Mulligane and Janet McMurdie in which Robert Mulligane would infeft and ‘sease’ Janet McMurdie in the life rent for her life time into the third part of the said 7s. 6d. land of Newtoune in the parish of Dunscore. This contract of marriage is subscribed at Dalgonar on 23rd November 1672, in front of William and Samuel Grierson lawful sons to James Grierson of Dalgonar, David Smith portioner of Bassiewalla and the said James Grierson, writer thereof. When Robert signs he writes his name as Millikane. Sasine was given up between 1-2 p.m. on 2nd December 1672 and witnessed by William Grierson son to the said James Grierson, Robert Halliday in Dalgonar, Andrew Berwick and William Edgar both in Newtoune.

[54] Lillias Maxwell spouse of Robert Mulligane in Newtounhead
August 29, 1674: Instrument of Sasine in favour of Lillias Maxwell in the lands of Newtounhead. Compared personally Robert Mulligane of Newtounhead of Dunscore heritable proprietor of the land under written and likewise compared Edward Walker in ‘Nether Cribitone’ procurator for Lillias Maxwell natural daughter to the deceased John Maxwell younger of Cribitone. And the said Robert Mulligane for fulfilling and observing his part of the contract of marriage made between him and the said Lillias Maxwell and this an other parts of the date of these present by virtue of which contract the said Robert Mulligane was specially bound and obliged to infeft and sease the said Lillias his future spouse in life rent during all the days of her life time in all and hail the just and equal half of the house, yard, pentacles and pertinents thereof lying the parish of Dunscore. Therefore the said Robert gave sasine with his own hands and delivered life rent state and sasine of the just and equal half of the 7s 6d. land of Newtounhead at 3 p.m. in the afternoon on August 29, 1674, in the presence of John McNesh in Newtounhead, Thomas Edgar son of John Edgar there, and John Berwick son of Andrew Berwick there.

[55] John Mulligane in Edgarton
November 20, 1675: Testament testamentar of Johne Mulligane in Edgarton who died in October 1675, faithfully made and given up by himself and by Janet Grearsone for the inventory as stated in his testament of January 22, 1662.
The agricultural inventory, of one old horse, cows sheep hogs and com, came with the insight and plenishing of the house and the clothes to £188 6 8d.
The debts owing to the dead with no Mulliganes involved came to £52.
Sum of the inventar and debts came to £240 6s 8d.
The debts owing out by the dead with no Muliganes involved came to £220.
There was one debt to John Grearsone in Mulligantoun £300 merks conform to a bond and mair to him £20.
This may have been Janet Grearsone’s father or brother.
Rest of free geir debts deductit came to £20 6 8d.
To be divided into 2 parts.
The latter Will dated January 22, 1662: ‘It is appointed and agreed betwixt the parties following that is to say John Mulligan in Edgartoune on the one part and Janet Grearsone his spouse on the other part in manner following’ etc. ‘as there is not children as yet procreate betwixt them’ they will leave the goods and geir to each other and will be the executors for each other.

November 24, 1691 [Dunscore] Instrument of Sasine in favour of William Neilsone and James Neilsone beyond the lane, attorney of for William Neilsone merchant in England, by Robert Mulligane portioner of Newtoune with letters of obligation made by Robert Mulligane to William Neilsone of the present date and by virtue of £126. 4s. money Scots the said Robert Mulligane infeft William Neilsone in all and whole the said 7s. 6d. land of the 30 shilling land of Newtoune lying in the parish of Dunscore and under reversion according to the letters of obligation. Sasine given between 11 and 12 am on November 24, 1691 and witnessed by Edward Maxwell of Straquhan, Thomas Smith in Dempsterton, Gilbert Neilsone in Kenmuir and James McMurdie in Laggan.

[59] Janet Grierson spouse of John Mulligane in Edgarton
April 21, 1696: [Dunscore] Instrument of Sasine given upon the ground of the 6/3d land of Edgertoune with the pertinents compeared personally James McMurdie in McCheynston as baillie in that part to the deceased John Milligan in Edgartoune and Janet Greirsone spouses specially constitute by the precept of Sasine. Also compeared John Rennick in Edgartoun having a bond of obligation made and granted by the said John Milligan and Janet Greirsone spouse to John Greirson in Milligantoun dated October 23, 1672, years for 300 merks Scots of principal to be paid between now and the term of Martinmas next to come with £20 penalty in case of failure together with the due and ordinary annual rent of the principal sum ... and for the more security the said John Milligan bound and obliged himself to infeft and seise the said John Greirson in the 6/3d land of Edgarton. And now the said John Greirson by a letter of assignation dated May 11, 1695, sold and assigned to John Rennick the debt and also the infeftment if there was no repayment. Sasine was given to John Rennick on April 21, 1696.

[62] Robert Milligane of Newtounhead
June 4, 1703: [Dunscore] Instrument of Sasine in favour of John Neilson. Compared John Neilson writer in Dumfries in whose favour the heritable bond is concocted together with a discreet man Robert Milligane of Newtounhead grantor of the said bond, for further security and more sure payment of the principal sum of £173 Scots money, John Neilson is infeft in a yearly annual rent of £10. 7. 6d. Scots money as being the due and ordinary annual rent of the aforesaid principal sum of £173 Scots, to be taken a two terms of the year Whitsunday and Martinmas by equal portions worth of all and hail the said Robert Milligane’s 7s. 6d. land called Newtounhead lying within the parish of Dunscore and sheriffom of Dumfries, or worth of any part or portion thereof readiest mails (rents), fermes (farm rents), profits and duties thereof, beginning the first term payment of the said yearly annual rent at the term of Martinmas next to come. This bond, was ‘always redeemable and under reversion’ of payment of the principal sum. Done on the ground of Newtounhead 1-2 pm in the presence of John Cunningham of Birkshaw, James Grierson of Dalgonar, Gilbert Neilsone in Cottach and Alexander Ireland servitor to the said John Cunningham by deliverance of earth and stone and one penny money as the use is.

[63] Robert Milligan of Newtounhead
July 1707: Testament dative of Robert Milligan in Newtounhead. The actual testament and its warrant are lost. The record of its existence survives in the minute book for the register of Testaments in the appendix under the heading ‘List of Testaments for which the record is now lost, taken from the Minute’. In the minute book, Robert is actually called ‘of’ Newtounhead. As it was a testament dative Robert Milligan in Newtounhead died intestate, and that his testament was just an inventory of his goods and gear and had no will attached.
