*SYNPOSIS: Jacob was such an early settler that he acquired a large plantation, raising cotton and thoroughbred horses. He became a prosperous and influential citizen in that part of Tennessee. He was a large land owner and appointed administrator and guardian of several families.
*NOTE: Most records in N.C. has this Jacob Jones listed as (S.C.)--which means Son of Council. This was to distinguish him from his father and uncle Jacob Jones who were all signing papers at the same time in Franklin Co,NC.
William Byrd of Franklin Co., N.C., sold to Jacob Jones (s/o Council Jones ) of Franklin Co., N.C., for a consideration of $143.75, 50 acres, part of a tract belonging to Enos Byrd: beginning at a Red Oak in Sion Boon's line, thence North 50 poles to a Pine in Jacob Jones„ line, thence West along said line 162 poles to a Post oak, thence South 50 poles to a Pine, thence East to the first station. Witnesses: Sion Byrd and Jacob Jones„ Jr. Proved 1818.

Jacob Jones petitioned the March 1815 Court of Pleas and Quarter Sessions, reciting that his father, Council Jones, departed this life on or about Mar 1805 after first making his last Will and Testament, wherein, among other things, he provided the tract of land whereon he then lived to his wife during her life, and after hear death to be equally parted between his four sons, Jacob, Allen, Council and James, and that his mother hath lately departed this life, whereby it becomes proper that the said land should be parted. Said land was situated in Franklin Co.,N.C.,on the north side of Tar River on both sides of Jumping Run. The original of this petition is extant and bears the signature of Jacob Jones .STATE OF N. CAROLINA) Pursuant to an order issued from the FRANKLIN Co., worshipful Court of the Co., of Franklin, we, the undersigned Commissioners, together with the Co., Surveyor ........ laid off into four lots, viz:
Lot No. 1. Drawn by Council Jones„ Jr containing 84.5 acres and valued at $320.00;Lot No. 2. Drawn by Allen Jones„ containing 72.25acres valued at $120.00;
Lot No. 3. Drawn by James Jones„ containing 76.25acres valued at $253.33; and
Lot No. 4, drawn by Jacob Jones , containing 83 acres and valued at $269.75. We further adjudge that Council Jones„ pay to Allen Jones„ the sum of $79.22, and that James Jones„ pay unto Allen Jones„ the sum of $12.56, and that Jacob Jones„ pay unto Allen Jones„ the sum of $29.0

After settling of his mother's estate and the selling of his lands, Jacob and Elizabeth Jones, went with her parents to join other Abernathy and Rivers relatives in Giles Co, Tenn.
On 30 April 1835, Joshua Jones, late of Franklin Co., N.C., but of Giles Co., Tenn., gave a bill of sale to Jacob Jones of Giles Co., Tenn., one Negro man by the name of Charles. Witnesses: Council K. Jones and Buckner Abernathy.

I, Jacob Jones„ of the Co., of Giles, State of Tennessee, being of sound mind but of feeble body, do make and ordain this to be my last will and testament, hereby revoking all others.
1st. I bequeath my soul to God who gave it and resign my body to the earth to be decently interred.2nd. I direct that my debts and funeral expenses be paid out of my estate as soon as practicable.
3rd. I direct that my whole estate be divided into (7) seven equal portions. One of which portions I give to the children of my son John R. Jones „ now born to him or that he may hereafter have, one of said seven portions, to redelivered him as their trustees, without any security and without any further qualification or appointment than that herein named; said portion to be kept together and managed by my said son John R. for the maintenance and education of such of his children as may be under age, now and hereafter born, until his youngest child shall become of age when he may, or before if he should think proper give to each one of his children an equal portion; or he may retain possession of said property and manage it for them, and use such of the profits and proceeds as may be necessary for his support; the balance of the profits and proceeds to belong to his children; it being the object to give the property and its proceeds to his children, but with permission to my son John R. Jones their trustee to take enough of the proceeds and the prof its should he require it as may be necessary for his support during his life, and at his death said property to be equally divided among his children. If any of his children should die before he or she should become of age or marry, his share to g to his brothers and sisters.
4th. One other seventh of my estate I give to my grandchildren James C. and Elizabeth Gordon to be delivered to their grandfather Col. Thomas K. Gordon to be kept together by him in this Co., as trustee without any further appointment or security until they severally become of age or marry when he is give off each a portion. Should either die before he or she becomes of age or marry, the other one is to have the whole.
5th. I give to my sons Council Kimbrall, Daniel Harper, James Calvin, Robert Norfleet and Benjamin Franklin Jones each one seventh (1/7) of my estate.
6th. The receipts of John R. Jones and Thomas K. Gordon shall be full vouchers for the portions committed to them as trustees.
7th. I direct that my faithful servant Acea be not estimated in dividing my Negro slaves but that he be permitted to live with such of my sons as he may desire, not being required to perform hard labor. I also direct that my servant Sarah, on account of her faithfulness to me during my affliction be permitted to choose her master among my sons and that she and any infant,should she have one, be valued to the master she may choose as a part of his seventh of my estate. Should the share of her master be unavoidably increased by her valuation and that of her child if she should have one, then the one receiving such shall receive that much less out of my land and other personal property.
8th. I direct that my slaves be divided into seven portions as nearly equal as may be and delivered over as above required. My sons or a majority of such as may be living to request a division at any time. They may effect a division by choosing five commissioners, discreet persons who shall divide said slaves in equal portions in value and allot them respectively to their respective owners or my sons and Thomas K. Gordon may agree to a division if practicable; The said Thos. K. Gordon and my son John R. Jones„ as trustees being fully authorized to represent and bind the parties for whom they are appointed trustees.
9th. I direct my land to be sold when, and in such manner and upon such terms as a majority of my sons or a majority of such as may be living at the time of sale may request and to be managed in the meantime as such majority may think best for all parties. The proceeds when collected to be paid overas above directed. When said land shall be sold the two of my executors shall be full and completed to vest the title subject only to the payment of the purchase money.
10th. Upon the division of my Negroes I direct that all my personal and perishable property be sold by my executors to the highest bidders, upon such terms as may be deemed best or they may sell such of it at private sales as he may deem best.
11th. I appoint my sons Daniel Harper Jones and Robert Norfleet Jones my executors to carry into effect this my will.
