Research of Houston S. Foster

John Edwards Foster was a Veteran of The Civil War and was awarded the Southern Cross.

Family lore [from my Grandfather James Sterling Foster] was that John got into a fight at Jones Cross Roads, Ga. and moved to Texas. During our research we found that John was listed as a witness in an attempted murder, John must have intervened in the fight on behalf of Littleberry Green who was according to the record assaulted by John Mann and assisted by Jefferson Mann. John E. Foster was not charged with anything.

The Grand Jury indictment May term 1855 for the fight accused John W. Mann and Jefferson Mann with the offense of assault with intent to murder.

Troup County July 1, 1854:
"With force and arms and with a certain iron spear which he the said John W. Mann in his right hand then & there had and held the said spear being then and there a weapon likely to produce death, in and upon one Littleberry Green in the Peace of God and said State then and there being did then and there with malice afore thought make an assault, and he the said John W. Mann with the said spear so held as aforesaid at against and upon him the said Litttleberry Green, did then and there violently and with malice afore thought strike and thrust with intent then and there him the said Littleberry Green with malice afore thought to kill and murder . And that the said Jefferson Mann was then and there with malice afore thought present aiding and abetting him the said John Mann in the assault aforesaid with the intent aforesaid in manners & form aforesaid to do and commit _____ contrary to the Laws of said State, the good order, peace and dignity thereof. May Term 1855."

The back of the Jacket for this case is marked "No Bill" so I don't think it was ever prosecuted.

Littleberry Green was some how related to Amy Foster, John E. Foster's mother, probably through her second husband Thomas W. Oliver. Amy is listed along with Littleberry Green as Heirs of Nancy Green.

John did move to Texas after moving to the Coosa/Elmore Co. AL. area. His wife died there and he remarried to Mary Elizabeth Lindsey then moved to Texas.

He passed away at the age of 81 1/2 years old. He saw a big change in the world during his lifetime. From what I have heard and my observations of doing the Foster history he was well loved and a hard-working man whose family was dear to him. His children and grandchildren grew up to lead good useful lives. I know he would have been proud of them all.

From Zada (Mears) Sharp in the 1970's

Jack was a salesman for the Stark Brothers Nursery in Louisiana and Missouri for fruit trees. When the G.W. Mears put out their big fruit orchard at Rayland, Wilbarger Co, Texas, Jack got the credit for the sale of the trees. At this time, Jack lived in Cass Co, Texas.

Jack had a son named Thad. Thad and Fanny Mears (nee Fanny Boon-wife of G.W. Mears) wrote to each other and kept up with each other for many years. Thad worked in the oil fields at Electra, Texas. One time he and his two girls - about 8 and 10 years old - and a big white female rabbit came to the MEARS farm on a visit. Fanny had all the kids at home splitting peaches from the big orchard so that they could be dried. When they were dried, the peaches were put upstairs in the MEARS' two-story house they lived in at the time. Thad FOSTER did not know about the peaches being in the upstairs room and let the rabbit up there. She pulled out her hair to make a nest in that pile of dried peaches and gave birth to some little ones right in the middle of that pile. Sometime later, Thad was transferred to southwest Texas to some oil field - probably around the Odessa-Seminole-Andrews-Midland Area.

Jack Foster had a brother named 'Ace'. Fanny Boon MEARS had a picture of him shown as a cripple in a chair. He was supposed to have arthritis -or another story is that he probably had polio. Jack and Ace Foster were uncles of Fanny (Boon) Mears.

    The 1930 census of Lubbock Co., Texas lists Edward Clayton as an undertaker. He apparently owned the funeral home as his real estate was valued at $12,500.

    He is also listed as being in WW1, where he was a physician in his 50's.

    Per research of Houston S. Foster

    Family lore was that Mary Lucille was born during the winter, prematurely. Her half brother, Edward Clayton Foster, was 20 years old and had studied medicine. Mary Lucille was so small that Edward put some flannel in a shoe box and placed her in it to keep her warm. He was her nurse and without him she probably would not have survived. She grew up to be an extraordinary person, and positively influenced the lives of everyone who knew her.
