

Bennett was born about 1815 in Franklin Co., NC where he spent his entire life. When he died, he left four young children from his 2nd marriage, plus 2 older daughters from his first marriage. This sparked several guardianship accounts and an estate that went on for several years after his death.

Eliza Wheless
Still looking for more information on Eliza Wheless. If anyone knows her parent's names, please write Ann (Jobe) Brown. There is an excellent chance that she may be a Boon descendant also or connected someway. There were many Wheless intermarriages with the Boon family.We know that Eliza died beween 1840 and August 1850 when her husband remarried. She left two young daughters, Jennett and Celesta.
Rhoda Upchurch
Rhoda was born about 1827 North Carolina and died betweey 1880 and 1892 Franklin Co., North Caroina. She was the daugther of Richmond Upchurch and Susan Bryant. Susan was the daughter of William Bryant and Mary 'Polly' Lewis.

The petition of Rhoda Boon, widow of Bennet N. Boon respectfully showeth to your worships that her said husband died intestate in Franklin Co., leaving him surviving the following children, to wit. Jeannett, Celestia, Elizabeth, Mary Frances, Martha, who are his only heirs at law.
Your petitioner further showeth that her said husband at the time of his death was seized in fee simple of a tract of land situated in said Co., adjoining the lands of William D. Coppedge and others and containing by estimation ____ [not filled in] acres. Your petitioner further showeth that she desires to have her dower in the said land allotted to her and to that end she prays your worships to order a writ to be issued to the Sheriff commanding him to summon twelve freeholders connected with the parties neither by ___ or affinity and entirely disinterested to view the aforesaid tract of land, and to allot and set apart ot her one third part thereof including the dwelling house and all out houses, buildings and improvements appertaining to the same for the term of her natural life and to report ehri proceedings in due form of law.
May it please your worships to order subpoenas with copies of this petition to be issued to the said heirs at law or their guardian if there be one requiring them to appear at the next term of this Court and show cause if any they can why the prayer of your petitioner shall not be granted. And your petitioner as in duty bound shall ever pray.

Stokes all of Franklin Co.,, in the state aforesaid are held and firmly bound unto the State of North Carolina to the sum of Fifteen Hundred Dollars to be paid to the said State, in trust for the benefit of the children hereafter named committed to the tuition of the said Spencer M. Boon To which payment well and truly to be made we bind ourselves and each of us, each and every of our heirs, executors and administrators, jointly and severally, firmly by these Presents. Sealed with our Seals, and dated the 15th day of December in the year of our Lord 1857 (or 1854).
The condition of the above obligation is such that whereas the above bounden Spencer M. Boon is constituted and appointed guardian to Jennette Boon & Celestia Boon minor orphans - now if the said Spencer M. Boon shall faithfully execute his said Guardianship, by securing and improving all the estate of the said orphans that shall come into his possession for the benefit of the said orphans until they shall arrive at full age, or be sooner thereto required, and then render a plain and true account of his Guardianship, on cash, before the Justices of our said Court, and deliver up, pay to, or possess the said, orphans of all such Estate or Estates, as they ought to be possessed of, or to such other persons as shall be lawfully empowered or authorized to receive the same, and the profits arising therefrom then this obligation to be void; otherwise to be and remain in full force and virtue.

The petition of Jennett Wilder, james H. Wheless and wife Celestia D. (Mary F. Boon, Elizabeth B. Boon, Martha A. Boon and Lucy B. Boon) the fourt latter infants under twenty one years of age by their guardian Rhoda Boon, respectfully sheweth nto your worships that they are tenants in common of a tract of land situated in Franklin and Nash Counties containing by estimation three hundred acres more or less, adjoining the lands of Thomas Bunn, W. D. Coppedge, James Privett, and others.
Your petitioners further show that they desire to hold and enjoy their shares of said land in severalty and to that end they pray your Worships to appoint five commissioners to divide the same into six equal shares by proper metes and bounds and to allot & set apart to each of your petitioners one share thereof and if an equitable division cannot otherwise be effected then and in that case to charge the more valuable divident with such sum of money as they shall judge necessary to be paid to the dividend of inferior value, in order to make the division equal, and to report their ___ under their hands and seals to the next term of this court. We the undersigned commissioners in obedience to an order of the Court of Pleas & Quarter Sessions made at September Term 1867 in the case of Jennet Wilder and others have after being duly sworn according to law divided the lands specified in the petition according to the directions of said order and in manner and form following
The lot No. 1 is assigned to Elizabeth B. Boon in severalty bounded as follows To wit beginning at a Black Jack the dower corner thence N3degrees E 106 poles to 2 pines thence east 78 1/2 poles to a stake & pointers, thence south 25 poles to a stake thence west 30 poles to a pine dower corner thence south 80 1/4 poles to the beginning containing thirty eight and one half acres valued at one hundred and fifty four dollars $154.

E 3 poles 9 links to white oak on Peach Tree Creek thence up the various courses of said creek to the beginning containing thirty-nine and one-half acres valued at one hundred and ninety-seven and one-half dollars $197.50

Boon in severalty bounded as follows to wit begining at a white oak on Peach Tree Creek thence S 52 1/2 W 3 poles 9 links to red oak thence south 76 poles to a stake thence East 86 poles to Horn Bear on Turkey Branch thence down the meanders of said Branch to Peach Tree Creek thence up the various courses of said creek to the beginning containing forty-four acres valued at one hundred and seventy-six dollars $176

Boon in severalty bounded as follows to wit beginning at a Horn Bear on Turkey Branch Corner of No. 5 thence west 133 poles to a sweet gum in dower line thence south 117 1/2 poles to a sweet gum on Turkey Branch, thence down said branch as it meanders to the beginning containing fifty-six acres valued at one hundred and sixty-eight dollars $168
We furthermore charge the ore valuable dividends with such sums respectively to be paid to those of inferior value as will make the division equal that is to say the lot No. 2 assigned to James Wheless and wife Celestia D. is to pay to the lot No. 3 assigned to Jennett Wilder the sum of thirty-six dollars and eighty cents $36.80
The lot No. 4 assigned to Martha A. Boon is to pay to the lot No. 1 assigned to Elizabeth B. Boon nineteen dollars and twenty cents, also lot No. 4 is to pay to lot No. 6 assigned Lucy B. Boon five dollars and ten centers $5.10. The lot No. 5 assigned to Mary F. Boon is to pay to the lot No. 3 assigned to Jennett Wilder two dollars and sixty five cents $2.65 and the lot No. 5 is to pay to the lot No. 6 assigned to Lucy B. Boon ten cents. All which is respectively submitted under our hands and seals this 2nd day of November 1867.

Boon of the second part of the Co., of Franklin and State of North Carolina; witnesseth that the said Martha Abernatha for and in consideration of the sum of Fifty dollars has bargained and by these presents doth grant, bargain, sell, and deliver the said Bennet N. Boon his heirs and assigns forever all my interest in a certain Tract of Land lying in and situate in the Co., of Franklin adjoing the lands of Cullen Braswell, David Bunn, & others and in the possession of Rahab Hammonds containg one hundred & fifty acres more or less with all and every appertenances thereunto beloning or in any wise appertaining. I do hereby covenant to and wish the said Bennt N. Boon that I have before the execution of this deed full right and absolute and lawful authority to sell the said land and premises and again hereby to warrant and forever to defend the right and title of the same to him the said Bennet N.
