This is the last Will and Testament of me William Cook of Latton in the County of Wilts Yeoman who being of sound and disposing mind memory and understanding praised be to God do make publish and declare the same in manner following that is to say Whereas a Settlement or Agreement hath been lately made and duly executed between me and my beloved wife Mary Cook of the one part and James Habgood of Eastington in the County of Gloucester Yeoman William Habgood of Toad Lane London Haberdasher and my Son Thomas Cook Trustees of the other part Now Doe hereby ratify and confirm the said Settlement or agreement in every respect And in further Confirmation thereof do give and bequeath unto my said wife all the monies securities for money and that property which she was entitled and possessed of and interested in at the time of her Marriage with me according to the terms of the said Settlement of Agreement I also give to my said Wife Mary the further Sum of Twenty pounds to be paid her by my Executors within Twelve months next after my decease provided she does not marry again but if she at any time marries again and hereby forefeits her widowhood Estate and Interest in the premises comprised in the said Settlement Then I revoke the said bequest of Twenty pounds to my said wife and direct that if the sum be paid to my said wife she shall repay it to my Executors for the benefit of my daughter Martha and in that Case I give the same sum of Twenty pounds to my Trustees herein named to be paid and applied so paid for the like purposes and Rents (?) and persons as the Provisions of my Estate is hereafter directed to be paid and applied All the rest residue and remainder of my Estate and Effects of what nature or kind xxxxx or wherever situate and being I give and bequeath unto the said James Habgood William Habgood Thomas Cook three (?) Executors and administrators Upon the xxxxx and Confidence xxxxxxxxxxx that they do and shall in their discretion make the most of the same and pay and apply the Interest produced thereof & after payment of my first debts and funeral Expenses & for and towards a comfortable Support and mainttainance for my daughter Martha during the term of her natural life But in case the interest and produce thereof shall be insufficient for that purpose then I wish and direct and request my said Trustees to raise advance and apply from time to time as they shall xxx xxxxxxxxxxxxxx and think fit out of the principla of the residue of my Estate raise (?) from there and other monies and things as shall or may in their discretion be thought fit and requisite for xxxx maintenance and comfortable Support
And I do hereby publish write and direct that the xxxx third part of the Estate Money or Annuity (as the case may happen to be mentioned and limited in the said Settlement in xxxxx for my said daughter Martha should be applied in manner and form and for the purposes aforesaid But in case my said daughter Martha shall not succeed (?) or xxxxx in xxxx of the whole residue of my property so bequeathed in xxxx as aforesaid then the Surplus I will and direct to go to and be divided amongst all and every my Grandchildren who shall be living at the time of my said daughters decease in equal shares
And lastly I hereby constitute and appoint the said James Hapgood William Habgood and my said Son Thomas Cook joint Executors of this my last Will and Testament hereby revoking all other Wills by me at any time heretofore made In Witness whereof I have published my last Will and Testament contained in three sheets of paper set my hand to the two first Sheets hereof and my hand and seal this third or last sheet thereof this sixth day of February in the year of or Lord One thousand Eight Hundred and two

The Will of Wm Cook decd
This Will was proved at Latton on the 29th April 1802 Before the Revd John Lyne Clk M.A. Lawfl. Surr. of the Revd & Worshipful the Archdeacon of the Archdeaconry of Wilts And by him Admin of the Goods estates & credits of the said decd & so forth was committed & granted unto Thos Cook lawful Son of the said deceased & one of the joint Executors within the named (the like power being reserved to James Habgood and Wm Habgood the other Exors also named in the said Will) being first duly sworn of the truth of the said Will to perform the same & pay the Debts & Legacies of the deced as far forth as his Goods, Chattles & Credits will thereto extend and the Law bind you to exhibit a true & perfect Invent & render a just Acct when required Saving the Rights of all persons.
