In the Name of God Amen I John Pitts of Brokenbury in the County of Wilts yeoman being weak of body but of sound and perfect mind and Memory Praise be given to almighty God I Do make and ordain this my present last Will and testament in manner and form following that is to say
ffirst and principally I Commend my Soule into the hands of Almighty God Hoping through the Merits Death and passion of our Saviour Jesus Christ to have full and free pardon and for Giveness of all my Sins and to inherit Ever Lasting life and my body I commit to the yearth to be Decently buryed at the Dirrection of my Executor here after named and as touching the Disposission of All such temporall estate as it hath pleased Almighty God to bestow upon me I give and Dispose there of as followeth that is to say
First I Will that all my debts and ffunnerall Charges shall be paid and Discharged
Item I Give and be quit unto my Loveing Wife Mary Pitts all my Reale Estate in manner and form as followeth, that is to say, the Halle and the Buttery adjoining to the said Halle and the to Chammers over the said Halle and Buttery and the Court Adjoining to the said Halle and the Garden joining also the said Halle and three appell trees in the orchot one called the yankoake appell and one called the Summer appell tree and the other Called the quining tree and Roome to sett or keep to or three Horses in the stable from the Day of my Deceas as Lng as She Shall happen to live and after her Decease it shall remaine and be unto my Executor here after named and all the Rest of my Reale Estat Houses Gardens Carksidd orchott Grounds leases meadows pastures what soever all being in Brokenbury afore said Shall be unto Samuel Pitts my Executor hereafter named During the full term of nine years after my decease for the payment of my Debts and paying unto my wife every year During the said term of nine years ffive pounds of lawfull mony Eight of the ffirst yeares and the ninth yeare ffifteen pounds of lawfull mony and at the end of the said term of nine years then all my Reale Estate afgoresaid shall Remaine and be unto my Wife for and During all her term of her natuall Life and after her Decease it shall Remaine and be unto Samuel Pitts my Executor hereafter named to he and his heires and Assigns for and During the Hole term and terms of years yeat to com and unacspired upon the said Estate and also I Give unto my wife all of the Goods that wase her own and all of my house hold goods for she to make use of it and keep it as long as shee do live and after her Decease it shall remaine and be unto they as I shall hand after mension and to load of wood to be delivered every yeare During the said term of nine years by my Executor and All the said sums During the said term aforesaid shall be paid every yeare at to equall payments one in at or upon the twenty ffifth day of March and the other in at or upon the twentyninth say of September
Item I Give and be quit unto my Coson Mary Pitts the Daughter of my Brother Simon Pitts Late Deceased Sixty pounds of Lawfull mony to be paid at three equall payments by my Executor here after named the first payment to be made and paid with in one yeare after my Deceas and my Wife Decease and the second payment to be made and paid with in ffour yeares after my Decease and my Wife decease and the third and Last payment to be paid and Made with in four years after my Decease and my Wife Decease and my warming pan.
(Item) I Give and be quit unto my Loving Coson Elizabeth Pitts the daughter of my Brother Simon Pitts Late Deceased Sixty Pounds of Lawfull mony to be paid by my Executor here after named at three Equall payments the first payment to be made and paid with in to yeares after my Deceas and my Wife Deceas and the second payment to be made and paid with in ffive yeares after my Decease and my Wife decease and the third and Last payment to be made and paid with in Eight yeares after my Deceas and my Wife Deceas
(Item) I Give and be quit unto my Loving Coson Sarah Pitts the daughter of my Brother Simon Pitts Late Deceased Sixty Pounds of Good and Lawfull mony to be paid by my Executor here after named at three Equall payments the first payment to be made and paid with in three yeares after my Deceas and my Wife Deceas and the second payment to be made and paid with in Six yeares after my Decease and my Wife decease and the third and Last payment to be made and paid with in nine yeares after my Deceas and my Wife Deceas and if any of the Sums a fore mentuioned Given unto my Cosons Mary Pitts Elizabeth Pitts and Sarah Pitts be not paid in manner and form as a fore said and it is Lawfully Demanded then it shall be Lawfull to and for the said Mary Pitts Elizabeth Pitts and Sarah Pitts to enter into the said estate here by Given to my Executor here after named in Six months after it is Lawfully Demanded and to keep it xxxx payment be made
(Item) I Give and quit unto my Brother Samuell Pitts ten pounds of Lawfull mony to be paid by my Executor here after named within Eleven years after mydecease and my Wife Decease
