THE WILL OF SIMON PITT, YEOMAN, OF BROKENBOROUGH

DATED 19 OCTOBER 1747

By the Permission of Almighty God the Nineteenth day of October in the year of out Lord Christ one thousand Seven Hundred and fforty Seven I Simon Pitt of Brokenborough in the County of Wilts Yeoman Do make and ordain this my Last Will and Testament in Manner and fforme following that is to say ffirst of all I Give and Bequeath unto my Son Samuel Pitt All that my Lease Hold Estate Situate in Brokenborough aforesaid Called Povey's To hold to him my said Son Samuel Pitt his Executors Admstrs and Assigns for and During the Remainder of the time and Estate I have therein and Thereupon I also Give Devise and Bequeath unto my said Son Samuel Pitt the Sume of five Pounds of Current Money of Great Britain Clear off and over and above all Taxes on payments whatsoever) a year yearly and for every year During the term of his Natural Life and I do hereby Charge and make Chargeable my ffreehold Estae Called Wallis's Situate in Brokenborough aforesaid with the Payment of the yearly Rent of five Pounds as aforesaid given to my Son Samuel Pitt Also I Give Devise and Bequeath unto my Son Isaac Pitt all that my Lease Hold Estate that was my Aunt Sarahs Called Back Bridge and those my Grounds Calles Buslades and the Grounds that I Lately Purchased of my Sister Croome Called Back bridge and the two Acres and Brandy Patch and the Mead Late Prices and my Aunt Pitts also Called Back Bridge and also the Lease hold Estate that I Purchased of the Widow Pitts and Also all that my Lease hold Estate that was my ffathers all which said Premises are Situate in Brokenborough aforesaid To hold to him my said Son Isaac Pitt his Executors Administrators and Assigns for and during the Remainders of the several terms and Estates I have therein and thereupon and my Will and true meaning is that my said Son Isaac Pitt shall Pay out of the Rents Issues and Profitts arising out of and ffrom my Lease hold Estates above by me Bequeathed to him) unto my son John Pitt the Sum of Sevenscore Pounds of Current Money of Great Britain within one year after my Decease Also I Give Devise and Bequeath unto my son Isaac Pitt all that my ffreehold Estate (Lately Purchased by me of William Gaze of Brokenborough aforesaid Deceased) Called Hormead To hold to him my Said Son Isaac Pitt his Heirs and Assigns for ever Also I Give Devise and Bequeath unto my Son Isaac Pitt All that my ffreehold Estate Situate in Milborne in the Parish of Malmesbury in the County of Wilts Lately Purchased by me of Thomas Saunders Deceased to hold to him my said Son Isaac Pitt his Heirs and Assigns forever Also I Give Devise and Bequeath unto my Son Joseph Pitt all that my ffreehold Estate Called Wallis's Situate in Brokenborough aforesaid Lately Purchased by me of Hugh Rogers Deceased To hold to him my said Son Joseph Pitt and the Heirs Male of his Body Lawfully Issuing for ever And in Default of Such Heirs Male and for want thereof I Give Devise and bequeath the Same Estate Called Wallis's to my Son Isaac Pitt To hold to him my said Son Isaac Pitt his Heirs (and) Assigns for ever I also Give and Bequeath to my Son Joseph Pitt the Sume of ffifty Pounds of Curent Money of Great Britain to be paid to him by my Executor in two years after my decease I also Give Devise and Bequeath unto my Son John Pitt all that my ffreehold Estate Called the Wood Pieces Lately Purchased by me of Walter Long Deceased Situate & Lying and being at Burlipp in the Parish of Bainsfield in the County of Gloucester And also all that my Piece of Land Lying in the Common ffield of Burlipp or Brimsfield aforesaid Lately Purchased by me of William Long To hold to him my said Son John Pitt and the Heirs Male of his Body Lawfully Issuning for ever And in Default of Such heirs Male and for want thereof I Give Devise and bequeath the Same Estates that I Purchased of Walter Long and William Long unto my Grandson Simon Pitt the son of Jospeh Pitt To hold to him his Heirs and Assigns for ever I Also Give and Bequeath unto my Grandson Simon Pitt aforesaid the Sume of fifty Pounds of Current Money of Great Britain If he should happen to Live to attain his Age of ffourteen years I also Give Devise and Bequeath to my Son Simon Pitt All that my ffreehold Estate Called Walkley Hill and water ffurrows Situate Lying and being in Milborne aforesaid by me Lately Purchased of Robert Stump To hold to him my said Son Simon Pitt and the Heirs male of his Body Lawfully Issuing for ever And in Default of Such heirs Male and for want thereof I Give devise and Bequeath the same Estate Called Walkley Hill and Water ffurrows unto my Son Isaac Pitt To hold to him His Heirs and Assigns for ever But my will and Meaning also is that which soever of my said two Sons Simon Pitt and Isaac Pitt shall be in the Possession of my ffreehold Estate Called Walkley Hill and Water ffurrows aforesaid shall Pay unto my Daughter Mary Rich wife of Styles Rich the sume of five pounds a year and so for every year yearly during her natural Life and I do hereby Charge and make Chargeable my ffreehold Estate Called Walkley Hill and Water ffurrows with the said yearly Rent charge of five pounds so to be paid to my said Daughter And my Will is that her Husband shall not Intermeddle therewith but that the Receipt of my Daughter Mary Rich only shall be a Sufficient Discharge for the Said Sume of five Pounds yearly I also give and Bequeath unto my Daughter Mary Rich the Sume of one Hundred and ffifty Pounds of Current Money of great Britain I also give and Bequeath unto my three Grandaughters Mary Pitt Sarah Pitt and Lydia Pitt (Daughters of my Son Simon Pitt) the Sum of ten Pounds Each to be paid by my Executor hereinafter named if they shall happen to Live to Attain their several Ages of ffouteen years and my will and Pleasure is that in Case Either of my three Grandaughters aforementioned should happen to die before they shall Attain their Ages of ffourteen years then I Give and Bequeath her or their Share or Shares so dying to the Survivor of them I also Give and bequeath unto my Kinsman Samuel Pitt son of my Brother Joseph Pitt the Sum of five Pounds of Current Money of Great Britain I also Give and Bequeath unto my Son Isaac All my Household Goods whatsoevere To hold to him his Executors Administrators and Assigns for Ever And also all the rest Residue and Remainder of my Real and personal Estate not herein otherwise disposed off I Give Devise and Bequeath unto my said Son Isaac Pitt To hold to him his Executors Administrators and Assigns for Ever And I Do hereby Nominate Appoint my said Son Isaac Pitt and Sole Executor of this my Last Will and Testament hereby revoking making Null and Void all former and other Wills by me at any time heretofore made and Confirm this to be my Last Will and Testament In Witness whereof I have hereunto Sett my hand and Seal the day and year first Above written

Xxxxx Will of Simon Pitt Decd

This will was proved at Sarum on the 25th day of Jany 1747 before the revd John Taliman Clerk M.A. lawfull Surrogate of the revd and Worshipfull Henry Stebbings D.D. Archdeacon of Wilts And by him Administration of the Goods and Chattels of the decd was granted to Isaac Pitt lawfull Son of the said decd & the Executor named in his Will (being first duly sworn (by virue of a commission in their behalf) of the truth of the Will to fullfill the ssame & pay xxxxx debts & Legacies as far as the effects will extend & the law binds & to exhibit a true Inventry synged as just Account when required saving the rights of all Persons

Henry Stebbing Doctor in Divinity Archdeacon of the Archdeaconry of Wilts, To our well beloved the Reverend Thomas Earle Daniel ffroor and Simon Crooke Health, We do hereby Authorize, impwer and give Commission unto you (in whom we perfectly Confide) jointly and Seperately to administer the Oath underwritten in manner and form there set forth unto Isaac Pitt the Laswfull Son of Simon Pitt late of Brokenborough in the County and Archdeaconry of Wilts deceased and sole Executor of his Last Will and Testament commanding you or either of you to duely to return these presents to us or our lawfull Surrogate or other Competent Judge in this behalf with a Certificate under your hands or the hand of either of you who shall duely execute this our Commission, testifying what you or either of you shall do in the premises on or before the last day of ffebruary next ensuing the date hereof otherwise tjhese presents to be void and of none Effect. Dated at Sarum under the Seal of our Office the ffifteenth day of January in the Year of our Lord One thousand Seven hundred and fforty Seven

The Forme of the Oath to be Administered to the abovenamed Isaac Pitt laying his right hand on the Gospell is as follows.

You swear that the paper writing hereto annexed doth in it contain the last Will and Testament of Simon Pitt your father late deceased so far as you know or believe, that you are the executor therein named that you will duely Execute and perform the same and pay his debts and Legarys so far forth as his Goods, Chattles and Credits will thereto extend and that the Law bind you that you will make or cause to be made a true and perfect Inventory of all the Goods, Chattles and credits of the said deceased which have or shall come to your hands possession or knowledge and Exhibit the same into the Registry of the Archdeacon of Wilts and pass a true and just Account on your Executor- ship when thereto lawfully required.

The Oath abovewritten was administered to the abovenamed Isaac Pitt and by him duly taken whilst touching the Gospell the Eighteenth day of January in the year of our Lord, One thousand Seven hundred and fforty Seven.
